Accused Cop Killer in Recent Area Shootout Appears in Court and Sees Preliminary Hearing Postponed

According to MetroNews, Nicholas County prosecutors and defense attorneys for accused murderer Brent Tyler Kelly agreed to postpone Kelly’s preliminary hearing until August in a meeting in Summersville Tuesday afternoon.
 
Kelly, of Birch River, is charged in the June 3 shooting death of Nicholas County Deputy Tom Baker. Another alleged shooter at the scene, Richie Holcomb, died in the shootout with police.
 
Kelly had been brought to Summersville from the Central Regional Jail for Tuesday’s scheduled preliminary hearing but he never appeared in the courtroom. He had a brief meeting with his attorneys in the Nicholas County Courthouse before the continuance motion was signed.
 
Senior Status Magistrate Marva Crouch said afterward that both sides wanted to give state police more time to finish their investigation.
