The trial of Mario Blount and Angela and April Davis has been postponed from its original Aug. 4 date.
On Thursday, U.S. District Judge Irene M. Keeley granted a joint motion for continuance.
“There will be a status conference on Monday (July 14) to discuss when the trial will be moved to,” said Emily Renzelli, law clerk for Judge Keeley. “Then an order will be entered, which will be made available to the public.”
The motion brought before Judge Keeley on July 10 was presented by J. Bryan Edwards, counsel for Angela Davis; Stephen G. Jory, counsel for April Davis and William D. Wilmouth, counsel for Mario Blount.
The motion states that all defense counsel and Assistant U.S. Attorney John Parr held a conference call on July 2 to discuss discovery issues and scheduling conflicts.
The postponement was requested for various reasons, including the fact that both Angela Davis and April Davis are currently being hospitalized and the duration of that hospitalization is unknown. Also, counsel for April Davis had a previously scheduled Aug. 4 felony trial in Monongalia County. That potential scheduling conflict was made known, the motion indicates, at the arraignment of the Davis women.
The joint motion for continuance also states that Parr has informed defense counsel that there is additional discovery that is forthcoming that is rather voluminous, disclosure of some of which will require the entry of a protective order.
The motion finally states that all counsel have reviewed their respective calendars and are available for the trial of the case September 8-12, September 15-17 or September 29-Oct. 3, 2014. That decision will be made at the July 14 status conference.
